类案检索机制与统一裁判尺度问题研究

A Study on the Retrieval Mechanism of Class Cases and the Issue of Uniform Judgment Scale

类案检索和案例指导两者表述虽略有不同,但就目的而言,没有本质区别。笔者认为类案检索机制的目的、作用大致有以下几种:减轻法官负担、提升法官素质;填补法律漏洞、规范司法裁量;统一裁判尺度、增强可预见性。网上公开的裁判文书质量参差不齐是一个令人担忧的问题,大多数案例研发团队通过机械抓取数据,对案件的要点、要素进行比较,进而能够推送相似案件的判例供查阅者参考,案例的质量、关联度、可借鉴性等无法得到保障,例如出现相似案件不同判决时,查阅者将无所适从。典型性案例库的建立将有可能解决此问题。

Case retrieval and case guidance are slightly different, but there is no essential difference in purpose. The author thinks that the purpose and function of the retrieval mechanism are as follows: lighten the burden of judges, improve the quality of judges, fill the legal loopholes, standardize judicial discretion, unify the judgment scale, and enhance predictability. The uneven quality of online adjudicative documents is a worrying problem. Most case research and development teams compare the main points and elements of a case by grabbing data mechanically. And then can push similar cases for reference, the quality of the case, relevance, referential and other can not be guaranteed, for example, when similar cases have different judgments, the examiner will be at a loss. The establishment of a typical case base will probably solve this problem.
