我国最高人民法院设立巡回法庭的理论分析

Theoretical Analysis of the Establishment of Circuit Court in China's Supreme People's Court

2014年10月20日至23日,中国共产党第十八届第四次全体会议通过了《中共中央关于全面推进依法治国若干重大问题的决定》,在《决定》中提出了最高人民法院设立巡回法庭,改善因地方行政的干预造成的司法审判不公的现象。本文主要从功能和价值分析角度来阐述我国最高人民法院巡回法庭制度,旨在我国建立更加完善的巡回法庭制度。

On October 23, 2014, the fourth plenary session of the 18 th communist party of China(CPC) adopted the decision of the CPC central committee on the comprehensive promotion of the rule of law on several major issues, in which the supreme people’s court set up circuit courts to improve the phenomenon of judicial injustice caused by local administrative intervention. This paper mainly expounds the circuit court system of the supreme people’s court of China from the perspective of function and value analysis, aiming at establishing a more perfect circuit court system in China.
