在中国发展的漫长道路之中,马克思主义理论一直是新中国发展最为重要的基础理论和基本原理,其中的法律部分和中国特色社会主义的法治理论有着较高的统一性和契合性。马克思主义产生于西方文明,我们对其进行使用就要让其不断地中国化,其中法律部分理论中国化的表现为:从马克思主义世界观和方法论的角度出发对中国法制建设的历程及特点进行重新审视和认识、以国情为基础来对中国的法制实践进行指导,让马克思主义法治理论以中国实际相融合,让具有中国特色的社会主义法治理论丰富马克思主义法制理论的内容,成为其与时俱进、不断发展的助推手。

In the long road of China’s development,Marxist theory has always been the most important basic theory and principle for the development of New China,the legal part of it has a high unity and consistency with the theory of legal governance of socialism with Chinese characteristics.Marxist originated from Western civilization,so we should use it continuously in China,in which the Sinicization of legal theory is manifested as follows:From the perspective of Marxist world outlook and methodology,this paper re-examines and understands the course and characteristics of China’s legal construction,and guides China’s legal practice on the basis of national conditions,let Marxist theory of rule of law be integrated with China’s reality,let socialist theory of rule of law with Chinese characteristics enrich the content of Marxist theory of rule of law,and become the main driving force for its continuous development with the times.
