民国婚约纠纷问题研究——以《申报》报道为例

A Study of Marriage Disputes in the Republic of China——Taking the Report of Shun Pao as an Example

进入近代后,依靠三纲五常为纽带维系的宗法社会逐渐解体,近代婚姻法制深入人心,但与此同时,落后的宗法意识仍然束缚人们的思维和习惯,新兴的西方权利意识与传统家族制的对抗影响到社会的方方面面,此时社会上的婚姻纠纷问题正是这种矛盾的体现,民国初年的婚约纠纷处理裁断较之传统社会已大不相同。

After entering modern times,the patriarchal clan society,which relied on the three principles and five permanent ties,gradually disintegrated,and the modern marriage legal system was deeply rooted in the hearts of the people,at the same time,however,the backward patriarchal ideology still restricts people’s thinking and habits,the confrontation between the emerging Western consciousness of rights and the traditional family system affects all aspects of society,at this time,the issue of marriage disputes in the society is just the reflection of this contradiction.In the early years of the Republic of China,the settlement and Adjudication of marriage disputes are quite different from the traditional society.
