摘要
按揭是房地产市场上一个实践性很强,又颇具理论性的问题,在我国又称为房地产抵押,与英美法上的原义有很大区别。目前我国相关的法律制度尚不够完善,对纠纷的处理各地存在不同的做法,借鉴英美法系的按揭制度,有助于解决按揭中的纠纷,可以有效地推动房地产市场的发展。
Mortgage,a issue with both practical and theoretical significance,is also termed real estate mortgage in China,which differs greatly fromits original meaning in British and American laws.Due to the incompleteness of related laws in China,ways to deal with mortgage issues vary form place to place.The author,therefore,suggests drawing on the mortage institutions in Uk and USA,which can promote the development of real estate market in China.
