中日关于中国古代土地法律制度研究之比较

A Comparison of the Research on Ancient Chinese Land Law System Between Japan and China

中国古代有着漫长的农耕文明历史和以农业为主体的生产传统,涉及土地权利和土地关系制度的规范与实践贯穿着中国古代经济社会发展的全过程。中日两国对于中国古代土地制度的研究在内容、研究方法和研究主体上存在着相似之处,但具体的着眼点却各自不同。本文通过中日两国学者对于中国古代土地法律制度的研究内容、方法和各自特点进行比较,对现有中国古代土地法律制度的研究形成宏观把控,各取所长,以期对中国现今土地产权制度和土地流转关系等突出矛盾寻求破题之道。

In ancient China,there had been a long history of farming civilization and agrarian traditions.The regulation and legislation about the agrarian relations between and land institutional norms and their practices had run through the whole process of economic and social development in ancient China.The research of the land law system in ancient China between Japan and China has been quiet different on their contents,methods and subjects.Through the comparison of both Chinese and Japanese scholars‘study of ancient Chinese legal system of land,study the methods and their respective characteristics of research,we can form a macroscopic understanding of the ancient Chinese land law system,in order to put forward the corresponding solutions on Chinese current problems on land property rights and rural land circulation.
