Swedish Patent Pledge System and Its Reference Value

1987年瑞典议会颁布了第1330号法案,对瑞典《专利法》进行了修改。其中将专利质押单独作为一章规定了11个条文,对专利权和专利申请权质押、重复质押、专利申请权登记簿、质权失效的除外规则都作出了明确规定。瑞典专利质押立法注重社会实际需要、追求效率与公平之间的价值平衡,具有明确的立法宗旨以及系统的法律框架,这些对我国专利质押立法都有很好的借鉴意义。

In order to amend the patent law,the Swedish Parliament enacted No.1330 act.There are 11 provisions on patent pledge,as a separate chapter in the patent law.The patent law in Sweden have made clear regulations on patent pledge、the pledge of patent applications、repeat pledge、the register of patent application right、the failure of pledge.Swedish legislation focus on the practical needs of society,and pursuit value balance on the efficiency and justice.The clearly legislative purpose and system framework on pledge are worth our country reference.
