On the Rule of Collateral Transfer

关于抵押物转让规则,存在自由转让说和限制转让说两种观点,《担保法》及其司法解释采自由转让说,《物权法》采限制转让说。根据新法优于旧法的原则,应优先适用《物权法》的规则。该规则主要包括以下几个方面的内容:一是物上代位权的行使,二是区分原则的贯彻,三是涤除权制度的适用。

There are two viewpoints about the rule of collateral transfer.One is free transfer and the other one is restriction of transfer.The first view is adopted by Guarantee Law and its relevant judicial interpretation.On the other hand,Property Law tends to use the restrictede transfer of collateral.As the new law is superior to the old one,we should adhere to the rule of Property Law.There are three aspects about the restricted transfer of collateral.No.1 Exercise of real subrogation of mortgage.No.2 Implementation of the division theory.No.3 Application of elimination right.
