未成年人刑事检察工作机制的调研分析——以B市为调研对象

Research Report on the Work Mechanism of the Juvenile Criminal Procuratorate——Take City B as the Research Sample

自2012年刑事诉讼法修改及施行以来,B市三级检察机关一直在探索未成年人刑事检察工作的新机制、新方法。调研显示,B市三级检察机关的未成年人刑事检察工作机制已经初步形成并初显成效,在办案主体专门化及办案模式、合适成年人参与制度、社会调查制度、附条件不起诉制度等方面有所创新和突破,刑事诉讼法规定的'未成年人刑事案件诉讼程序'较好地得到了落实。

Since the modification and implementation of the Criminal Procedure Law(2012),the three level procuratorates of B city has been exploring the new mechanisms and methods of the juvenile criminal procuratorate.The research shows that the work mechanisms of the juvenile criminal procuratorate of the three level procuratorates of B city have formed initially and achieved some initial results.For example,the specialization of the personnel and working pattern,the appropriate adult participation system,the social investigation system and the conditional non-prosecution system have gained some innovation and breakthrough.The procedures for criminal cases committed by minors that stipulated by the Criminal Procedure Law(2012)have been well implemented.
