摘要
职务科技成果是新科技成果转化法中出现的新概念。结合新法的相关规定,科技人员在职务科技成果转化中,虽并非成果的享有者,却是转化的参与者及利益的共享者,当然在非法竞业或泄密之后也须承担相应的责任。
Service scientific and technological achievement is a new concept in Law on Promoting the Transformation of Scientific and Technological Achievements 2015.Combined with the provisions of the new law,personnel are the participants of transformation and the sharers of interest,instead of the owners of the achievements in the transformation of service scientific and technological achievements.Of cause,they should bear legal responsibility when illegal competition trade and leaks happened.
