Analysis the Medical Malpractice

近年来 ,医疗损害事件大量出现 ,已成为全社会关注的一大焦点。但由于我国在这方面立法的不统一和相对滞后 ,给此类案件的处理造成很大的困难。为了切实维护医患双方的权益 ,调整医患关系 ,尤其是贯彻民法保护弱者利益的理念 ,本文试对医疗损害赔偿相关的法律问题进行探讨 ,并提出相应的立法建议。

These years,the medical malpractice has appeared largely and become a focus in the society.But the legislation in our country is relatively behind and not unified.So it has caused many difficulties in the disposal of these cases.In order to defend the rights and interests of the two parties,adjust the relationship between them,especially protect the benefit of the victims,this treatise will study some legal problem in medical malpractice and put forward correlative judiciary proposal.
