知识产权的民事权利属性已得到确认,但对于民法典中是否应包含知识产权法的内容,知识产权在民事权利体系中是何地位等问题,还存在不同认识。通过疏理有关线索,应对知识产权作为一种财产权实现正确的定位。知识产权属于广义上的无形财产权,无形财产权的体系包容但不限于知识产权,无形财产权体系呈现零散、各别的特征,难以加以整合,知识产权在其中应以独立的特别法的形态得到体现。那种把无形财产等同于知识产权的观点值得商榷。

Intellectual property is a kind of civil rights. There are different opinions about whether civil law code should include the intellectual property or not. The author thinks that intellectual property law should be took as a special part of property law. The theory that considers intangible property to be equal to intellectual property is not completed.
