我国公立高等学校的应然法律地位探究

Probe on Due legal status of Public Colleges and Universities in Our Country

当前,我国公立高等学校均为事业单位,这使得高等院校在法律定位上存在一些局限性,遇到了一些法律实务困境。为解决这一困境,笔者提出了将高等院校的法律主体界定为公务法人,以探索高等院校的应然法律地位。

At present,our public colleges and universities are public institutions,which leaves some limitations in the legal status,therefore,exists some difficulties in some legal practice;in order to solve this problem,the author proposes to defined legal subject of higher learning as the official corporate legal entity in aim of exploring its due legal status.
