完善外国人在我国参加社会保险法律机制研究

Perfecting the Social Insurance legal mechanism for Foreigners Working within the Territory of China

我国首次强制要求外国人参加社会保险,本文分析了扩大社会保险保障对象须考量的因素,提出了外国人在我国参加社会保险法律机制存在的不足,并给出了完善建议。主要为修正"在我国就业的外国人"这一概念,明确外国人参加我国社保享受国民待遇,与其他国家签订双边协定并且完善双边协定的内容,针对外国人享受我国社保待遇规定特殊条件。

It is the first time that China requires foreigners to participate in our Social Insurance System. This article analyses the factors that should be taken into consideration when enlarging Social Insurance System coverage. Besides,it puts forward the shortages in the legal Mechanism of Social Insurance System Coverage of Foreigners. Finally,it gives four proposals on how to perfect the according legal mechanism.
