台海两岸警方加强合作共同打击犯罪的现状及路径探析——以闽台警方合作打击犯罪实务性研究为视角

The Present Situation and Path Analysis about Cross-strait Police Cooperation in Combating Crime-In the Combating Crime Practical Perspective from the Cooperation Between Fujian and Taiwan

近年来,两岸关系实现历史性转折,随着双方人员往来与经贸交流的频繁,两岸司法机构受理的互涉案件不断增多。虽然海峡两岸特别是闽台警方在共同打击犯罪方面取得一定成效,但由于两岸政治体制、刑事法律方面存在的差异及两地司法部门间缺乏顺畅的沟通配合,双方在共同打击跨境犯罪中存在调查取证难、查处追究难、返还赃款难等问题,影响了两岸对跨境犯罪行为的打击与惩处力度。本文从闽台两地警方打击跨境犯罪活动的实践出发,研究加强两地协作机制建设,探寻两岸共同打击犯罪的有效途径。

In recent years, relations across the Taiwan straits have achieved a historic turning point, along with frequent personnel exchanges and economic and trade exchanges, cross-strait judiciary has also accepted the increasing cases involved. Although the Taiwan Strait especially between Fujian and Taiwan, the police achieved some success in fighting against crime, because of cross-strait political system, differences in the legal aspects of the criminal justice sector and the lack of both smooth communication with the two sides, there still exists some issues in the fight against cross-border crime,such as difficult investigation, difficult pursuing investigating, the return of stolen money, which affect both sides of the fight against cross-border crime and punishment. This article, setting out from Fujian and Taiwan police in combating cross-border criminal activities, researches the cooperation mechanism to strengthen the construction of the two places, and explores effective ways to combat crime.
