论广义担保理论体系下行政担保立法的完善

Improvement of Administrative Bond under the Theory of Generalized Guarantee System

为了加强不同领域担保之间的联系、缩小部门法划分所导致的不同领域担保之间的隔阂,同时促进非民事领域担保对相对完善的民事担保相关规定的借鉴,本文突破将担保局限于经济活动中债的担保的观点,运用公私法融合的理论,将不同领域的担保融合进广义的担保理论体系。并在广义担保理论体系的基础上提出合理借鉴民事担保、进而完善行政担保的若干建议。

To enhance the connection of guarantee forms in different areas and to reduce the boundaries caused between them by division of law departments;at the same time,to stimulate administrative bond referring to the regulations of civil guarantees,the paper breaks the limitation of civil guarantee in the Guarantee Law by combining guarantees in different areas into one theory system based on civil-public law fusion background. According to the generalized guarantee theory,proposes suggestions concerning the improvements of administrative guarantee in China.
