现代西方法治精神的源头可以追溯到文艺复兴时期。文艺复兴提倡以理性反对神性,以人权反对神权,以科学反对神学,奠定了现代西方法治精神的理性根基;文艺复兴提倡的自由、平等、民主、公正等价值观决定了现代西方法治精神的价值取向,为法治社会的形成提供了深厚的文化底蕴;文艺复兴彻底打破了神权诫命的统治,树立了现代西方社会的法律笃信思想。文艺复兴对于现代西方法治精神的形成具有奠基性作用,时至如今,对于当下我国社会主义法治社会的建设仍然具有重要的启示与借鉴意义。

The origin of the spirit of West rule of law in the modern can be traced back to the Renaissance. The Renaissance laid the rational foundation of the modern western spirit of rule of law by reason against divinity,human rights against theology and science against theology. The values of freedom,equality,democracy and justice advocated by the Renaissance determined the value orientation of the spirit of the rule of law in the modern West and provided a profound cultural foundation for the formation of the society ruled by the rule of law. The Renaissance has completely broken the rule of the commandment of theocracy and established the belief in the law of modern western society. The Renaissance has laid an essential foundation for the formation of the modern western spirit of the rule of law. Up to now,it still provides important enlightenment for the construction of the socialist rule of law in our country.
