审判机关在刑事二审程序中履行审判职能存在问题的原因是多方面的,其中刑事二审程序设计的不完善以及审判行为操作的不规范是主要原因。因此,应对刑事二审程序作进一步的修改和完善,科学规范审判行为,以促进司法公正的实现。

There are some problems existing in judicial function of the judicial organs in the criminal procedure at the second instance.The imperfect design of the criminal procedure at the second instance and the disorder of the performing of the judicial action are the main reasons.Therefore,we should revise and perfect the second criminal procedure for the realization of judicial justice.
