摘要
互联网购物具有技术性强、创新程度高、用户群庞大的特点,该领域内经营者的竞争尤为激烈,不正当竞争行为也层出不穷。其中,隐蔽性高、行为方式多样、违法成本低、行为危害大的商业诋毁行为是该领域较具代表性的行为之一。在互联网购物领域,违法主体主要通过互联网交易平台和技术平台从事商业诋毁行为,这些行为的出现的主要原因是相关法律法规不完善、互联网交易平台信用评价体系不健全及互联网平台运营商监管责任不明确。本文针对互联网购物领域商业诋毁行为法律规制的困境,提出具体的规制对策,以维护互联网购物领域正常的竞争秩序,切实保护该领域经营者的商誉权。
Online shopping has such characteristics as high technology, rapid innovation and huge size of user group. Competition in this field is particularly fierce and new type of unfair competition behaviors are emerging in an endless stream. Among these behaviors, commercial defamation is a typical one with high concealment, various performances and great harm. In the fi eld of online shopping, commercial defamations are performed by operator through Internet trading and technical platforms. The emergence of this behavior mainly results from loophole of legal regulation mechanisms, defection of the credit evaluation system and ambiguity of government oversight. In order to defend the competition order of online shopping area and protect the goodwill right of operators, this article brings out several specifi c solutions to above-mentioned problems.
