摘要
《最高人民法院关于审理侵犯专利权纠纷案件应用法律若干问题的解释(二)》第二十四条对推荐性标准中明示专利信息的必要专利所涉的专利侵权纠纷认定进行了规定。本文从该条款的适用对象、适用前提、行为定性等方面进行说理解读,以期有助于实现对于该条款的准确理解和适用。
Article 24 of Interpretation by the Supreme People's Court on Some Issues Concerning the Application of Laws to the Trial of Patent Infringement Disputes(Ⅱ) regulates relevant issues on patent infringement cases concerning essential patents which have been disclosed in recommended standards. In order to promote the precise understanding and application of Article 24, this article interprets the applicable object, applicable prerequisite and behavior analysis and so on.
