The Basic Study on the Theory of Superior Bargaining Position

本文通过梳理我国关于相对优势地位理论的争议,考察了问题产生的根源及其实质分歧所在。同时对国外相关问题进行研究考证,试图就我国竞争法体系中是否能导入相对优势地位规制的基础理论性问题提出一个新的思考视野。

Through sorting out the disputes on the Superior Bargaining Position Theory of China, the article has examined the root as well as the substantive disagreement of this problem. With comparing the relevant foreign issues at the same time, the author is trying to put forward a new vision on this fundamental theoretical problem that whether competition law system in China should import the regulation of Superior Bargaining Position or not.
