关于职务犯罪的主体 ,司法实践中就存在大量的问题 ,理论界对此也进行了大量的研究 ,但至今问题没有解决。本文就我国渎职罪主体的立法及司法问题及理论冲突进行了相关分析 。

Great controversy exists in the studies of the subject constitution of dereliction of duty and problems abound in the practice of jurisdiction in the field. The paper is an analysis of the problems concerning the legislation and jurisdiction as regard this offence, with the author’s own suggestions as to what measures ought to be taken to improve the situation.
