知识产权的重构——网络时代对知识产权内涵和外延的冲击

Reconstitution of Intellectual Property ——An impact to the intension and denotation of intellectual property by network time

随着网络时代的来临 ,产生了许多需要由知识产权保护的新的客体 ,诸如多媒体、数据库、域名等 ,本文论述了客体的增加不仅对传统知识产权的外延产生冲击 ,更主要的是向知识产权的内涵发起挑战 ,传统的知识产权必须重构——由知识产权向信息产权转变 。

With the advent of network time, many new objects that need the protection of intellectual property exist, e.g. multi media, database, realm name etc. This thesis discusses that the increase of objects is not only an impact to the denotation of traditional intellectual property, but also a challenge to the intension of intellectual property actually. Thus traditional intellectual property must be reconstituted intellectual property change to information property so as to adapt to the development of times.
