从垦荒说起——兼论农村集体土地承包经营制的缺陷及完善

A Study Originated from the Reclamation of Wasteland --On the Defect and Improvemen of the Contracting Out System of Collective Land

承包经营制是我国农村集体土地使用权行使的基本方式。该制度一方面有利于调动农民的生产经营积极性,一方面又存在一些缺陷,如理论上不成熟,承包合同标的物的非周延性,承包合同的粗疏性、滞后性以及阻碍土地使用权的流转等,容易导致权利的滥用。为此,可以从加强理论探索,改善法律制度,开展基础工作,推动农村土地使用权市场化,加快农村基层组织的自治化步伐等方面来进行完善。

The contracting out system is the basic way in which the right of collective land is practiced. On the one hand,the system heaves up the peasant's enthusiasm in laboring and managing;On the other hand,it's immature in theory,and the contract is inclusive,careless and sluggish. So, we would improve the system through sesearch,Land Law,basic work and land market construction and peasant's autonomy,etc.
