中国和欧盟反倾销法律机制比较研究

Comparison between the Anti-dumping Legal Systems of China and the EU

中国于 2 0 0 1年 11月 2 6日通过了新的《中华人民共和国反倾销条例》 ,并于 2 0 0 2年 1月 1日起生效。欧盟对其第 384 96号反倾销规则的部分内容再次作了修改 ,新的欧盟《反倾销规则》于 2 0 0 2年 11月 5日公布 ,2 0 0 2年 11月 6日生效。本文对中国和欧盟反倾销法进行了比较研究 ,指出了二者的异同 ,并提出了完善中国反倾销法的立法建议。

The new Anti-dumping Act was passed on Nov. 26,2001 in China, and took effect on Jan.1,2002. The EU made an amendment to parts of the No.384/96 Anti-dumping Rule and resulted in the new Anti-dumping Rule, which was announced on Nov.5,2002 and took effect on Nov.6,2002. This paper compares the anti-dumping laws of China and the EU. It points out the differences between the two legal systems and puts forward the legislative suggestions of China's perfecting the anti-dumping law.
