Elementary Exploration of Principles of Infringement Law

侵权法原则的确立 ,是侵权法体系完善的需要 ,也是法治社会权利保障的需要。侵权法原则体现着侵权法的本质和根本价值。侵权法应确立其五大原则 :权利保障原则、侵权法定原则、责任公平原则、救济合理原则及利益衡平原则。只有这样 ,才能够进一步完善侵权法学科体系 ,充分发挥侵权法保障权利。

The establishment of principles of infringement law is the need for perfection of infringement law and guarantee of rights of society with a legal system. The five principles of infringement law should embody the nature and basic value of the law: principle of rights protection, defining principle of infringement, principle of responsibility justice, principle of reasonable relief and principle of interest equity.
