对学校在学生伤害事故中的主体资格及归责原则的再认识

摘要 围绕学校在学生伤害事故中的责任问题,着重从主体资格和归责原则的角度展开研究,提出了“学校不是未成年学生的监护人,但在一定条件下可以、甚至应当负有某些监护职责”的观点。监护职责可分为“法定监护职责”和“约定监护职责”、“监护人的监护职责”和“非监护人的监护职责”,并详细比较了后一分类中两种不同的监护职责的区别。最后,就《学生伤害事故处理办法》的合法性和公正性问题作了论证。 A study is carried out around the responsibility problem of student injury incidents in schools, and emphasis is put on the subject qualification and the responsibility imputation principle. Here put forward is the idea that schools are not minors' guardians, but under certain circumstances can and should take some guardian duties. Guardianship can be divided into statutory guardianship and conventional guardianship, and guardian's guardianship and non-guardian's guardianship. A detailed explanation is given to the difference between the two different duties in the latter. Finally expounded in the paper is the impartiality and legality of 'Ways to Deal with Student Injury Incidents'.
