对精神损害赔偿主要功能的认识是我国精神损害赔偿制度的"观念瓶颈"。当前将惩罚作为精神损害赔偿主要功能的主流学说是值得商榷的。精神损害赔偿的主要功能是补偿而不是惩罚 ,只不过兼具"惩罚性"

The attitude to the primary function of paying for mental hurt is the 'conceptual bottleneck' to perfect our interrelated law system. The dominating theory which considers punishment as the primary function of paying for mental hurt deserves to be discussed. The primary function of paying for mental hurt isn′t punishment but compensation, with a slight effect of punishment.
