论行政法的价值

On the Value of Administrative Law

行政法的便民价值是行政法的诸多价值。便民价值对行政活动至少有三个方面的要求 :第一 ,行政活动必须高效 ;第二 ,行政活动必须合法 ;第三 ,行政行为必须公开。为了充分体现便民价值 ,应从三个方面加以重视 :1 听证制度 ;2 行政的社会知悉权和参与权 ;3 强化立法上的具体性和可操作性。

The value of administrative law lies in its convenience value for the people, by which the administrative activities are required at least to: 1) be highly efficient; 2) agree with law; 3) be made public. In order to effect the convenience value for the people, attention should be paid to the following three aspects: 1) system of hearing; 2) public right of being informed; 3) making the legislation concrete and practicable.
