试论我国电子签名法律制度的建立

On the Establishment of Chinese Legal System of Electronic Signature

电子签名是网络交易的重要环节。在介绍国外有关电子签名的立法规则、内容、现状及趋势的同时,提出中国应尽快建立电子签名的法律制度,构建中国电子签名立法的基本原则及内容体系,从而适应我国电子商务发展的需要。

Electronic signature is an important element in network transactions. This paper first addresses e-signature in term of relevant legal rules, content, current situations and tendency in other countries, and then states that it is urgent for China to establish the legal system concerning e-signature. It also discusses some fundamental legislative principles and content systems, so that the e-signature system could well meet the requirements of e-commerce development in China.
