共同犯罪的成立特征与共同犯罪的犯罪构成是两个不同的概念。共同犯罪的成立特征是共同犯罪区别于单独犯罪的特殊性,而共同犯罪的犯罪构成与单独犯罪的犯罪构成则是相同的。而且,共同犯罪中各共同犯罪人成立犯罪所具备的犯罪构成也是相同的。
