利用多边投资担保机制防范中资企业“走出去”政治风险

Research on Preventing“Going Global”Political Risk of Chinese-funded Enterprises through Full Use of MIGA

政治风险往往关乎海外投资的成败,但仅凭企业自身能力又难以规避抵御。为降低中国企业在海外投资中面临的政治风险,加大中资银行对中国企业"走出去"的支持力度,加强保险对中国企业在境外项目的保障作用,本文对"多边投资担保机构"(Multilateral Investment Guarantee Agency,MIGA)政治保险的险种、优势等相关法律问题进行了考察研究,结合中资企业"走出去"投保政治险的实践和需求及利用MIGA对"一带一路"项目保险的有利方面,提出了政策建议。

Political risk plays an important role in deciding success or failure of overseas investments,but enterprises can hardly avoid and resist such risks by virtue of their own capabilities.In order to reduce the political risk faced by Chinese enterprises in overseas investments,strengthen Chinese bankssupport for Chinese enterprises to 'go global'and strengthen insurances guarantee of overseas projects of Chinese enterprises,the paper investigates and researches the insurance types,advantages and other relevant legal problems of political insurance of'Multilateral Investment Guarantee Agency'('MIGA'for short).In combination with Chinese-funded enterprisespractice and demands in effecting political insurance for'going global'as well as advantages of MIGA application in 'One Belt and One Road'project insurance,the paper puts forward policy suggestions.
