摘要
本文以长三角地区农村集体经营性建设用地使用权流转为例,结合经济学与法学理论,探讨了农村集体经营性建设用地使用权流转的形式与相关法律法规,着重分析了农村集体经营性建设用地使用权流转试点地区的案例,揭示了农村集体经营性建设用地使用权流转机制实践中存在的问题和原因,并给出了相应的政策建议。
This article,based on a case study about the use rights transfer of rural collectively-owned land for for-profit construction in the Yangtze River Delta,adopts theoretical frameworks of both economics and law to research the use rights transfer patterns and related laws regarding this type of land.Through an analysis of the pilot case on use rights transfer of rural collectively-owned land for forprofit construction,the article points out the problems in transfer of the land as well as the factors responsible for the problems,which are followed up with corresponding policy recommendations.
