我国的刑事证人保护制度现状分析及完善

新刑事诉讼法进一步明确、完善了证人出庭制度,并且新增了证人保护方面的内容,在证人保护制度保护方面取得了一定的进步,但是司法实践中证人害怕打击报复,出庭率不高的现象仍然盛行。出庭率低已经成为现在刑事诉讼案中最重要的问题。为解决这一问题,针对我国的刑事证人保护制度还存在保护机关责任分工不明确、刑事证人保护措施内容不完整和刑事证人作证经济补偿制度不完善的缺陷,需要从明确保护机关责任分工、补充刑事证人保护措施内容和建立有效的刑事证人作证经济补偿制度等几个方面对我国的刑事证人保护制度予以逐步完善。
