依法治国方略下医学生法治教育模式创新探究——以“模拟法庭”为例

Innovation of Law Education Mode for Medical Students under the Strategy of Managing State Affairs under the Rule of Law——Take "moot court" as an example

十八大以来,在"全面推进依法治国"与新十六字方针的指导下,教育部提出了"依法治校"与"依法治教"的观点。纵观医患关系现状以及当今医学生法律意识普遍缺失,传统的法治教育模式已不能满足医学生对法律知识的需求。本文通过对政策文献的查阅以及对于医学生现实情况的问卷调查,结合医学生的专业特点和临床实践的需要,创造性的提出了医学生法治教育新模式——"模拟法庭"。本文介绍了"模拟法庭"的教育形式,深入分析了"模拟法庭"对于医学生法治教育的重要意义。最后又针对如何改进"模拟法庭"现存模式、扩大"模拟法庭"的影响提出了自己的观点。

Since the Eighteenth National Congress of the CPC,under the guidance of 'comprehensively promoting the rule of law' and the new sixteen character policy,the Ministry of education has put forward the view of 'managing schools by law' and 'administering the country by law'.In view of the current situation of doctor-patient relationship and the lack of legal awareness of medical students today,the traditional law education model can not meet the needs of medical students for legal knowledge.Through access to the policy document and questionnaire survey for the reality of medical students,combined with the specialty of medical students and clinical practice,creatively put forward the rule of law education for medical students:the new mode of 'simulation of court'.This paper introduces the form of 'moot court',and analyzes the significance of 'moot court' to the rule of law education for medical students.Finally,the author puts forward his own views on how to improve the existing pattern of 'moot court' and enlarge the influence of 'moot court'.
