摘要 全球气候变化加剧、环境问题日益突出,国内"资源依赖型"发展方式不可持续,国家提出了绿色发展理念,出台了许多支持绿色产业、绿色技术优惠措施,但十分零散未成体系,整体性效果未得到充分发挥,有必要立足于公共政策的角度加以梳理,结合专利制度构建起支持绿色专利优先发展政策体系,以激励绿色技术创新、促进绿色产业的发展和环境保护。本文从绿色专利的界定、优先发展的含义、政策的目的设定与价值选择三方面对绿色专利优先发展政策做了总体构想,并从激励绿色专利的创造、完善管理、促进运用、加强保护进行了优先发展政策体系的具体设计。 Global climate change and environmental problems are intensifying,and the 'resource- dependent' mode of development is unsustainable, so our country have advocated the concept of green development and introduced many preferential measures to support the green industry and green technology. However, they are scattered and not systematic, and the overall effect has not been full worked. Based on the public policy and combined with the patent system, it is necessary that we should establish and systemize the green patent development priority policy system in order to encourage green technology innovation, promote the development of green industry and protect the environment.This article discusses the overall scope and overall vision of the green patent development priority policy system from three sections: the definition of green patent, the meaning of the prior development, and the purpose and value of the policy. In addition, the article builds up some details about the green patent development priority policy systemfrom stimulating green patent creations, perfecting green patent management, promoting green patent application and strengthening green patent protection.
