纳西族殉情现象的法社会学解读

Interpretation of the Nakhi's “Die for Love” Phenomenon in the Perspective of Sociology of Law

纳西族在清朝"改土归流"之后,出现了独具特色的殉情现象,这是一种文化扭曲现象。从法社会学的角度来看,是正统的制度对非正式的少数民族文化蛮横干涉的结果。法律制度应当以社会文化为基础,切不可轻易对社会文化进行盲目的改造。在今天的法治建设中,应当以史为鉴,尊重各种非正式的制度与文化,逐渐消除历史遗留的殉情现象,并避免类似的现象再次发生。

After the bureaucratization of native officers in Qing Dynasty,the Nakhi appeared the special phenomenon of'die for love',which is a twisted cultural phenomenon. From the perspective of sociology of law,it is the rude interferenceof official system to informal culture of minority. Legal system should based on social culture,which should not be trans-formed blindly. In today's legal construction,the historical experience should be considered,all kinds of informal institu-tions and culture should be respected,the historical remained phenomenon of die for love should be eliminated graduallyand similar phenomenon should be avoided in the future.
