摘要
本文以《联合国宪章》第七章第42条为依据,对国际关系学界关注较少的联合国武力强制行动同当今国际社会所倡导的"保护的责任"之间的关系进行了剖析,旨在探讨"保护的责任"理念在指导联合国实践,特别是武力强制行动过程中所产生的效用,并以时效性较强的利比亚战争为案例展开说明,解释了联合国武力强制行动目前对"保护的责任"的贯彻程度以及仍存在的缺陷,为此理念在联合国行动中的进一步发展和完善提供借鉴。
According to the UN Charter Chapter7 article 42,this paper illustrates the UN enforcement action and the relationship with ‘R2P'( responsibility to protection),aiming at finding out how does this concept guide UN actions,especially in the military enforcement action who is related to human right and sovereignty tightly. This paper selects Libya war as case,so as to further explain the faults of UN enforcement action in implementing‘R2P'. Besides,this paper also hope to provide suggestion for the development of UN enforcement action in the future.
