摘要
随着我国农村经济体制改革的深入发展 ,农村土地使用制度 ,尤其是现行的农地承包经营制度逐渐表现出诸多的不适应 ,迫切需要进行相应的变革。针对农地使用制度的完善 ,经济学家提出了农地租赁制度的改革方案。本文在分析农地使用制度现状及存在问题的基础上 ,试图从法律角度入手对农地租赁制进行探讨 ,并提出在我国即将出台的《物权法》中引入农地租赁权的概念 。
With the construction of the socialism market oriented economy and the deep development of the countryside economic structural reforms, the land contract system of countryside shows much unsuitability and need reforms. Economists raise a reform scheme of countryside land tenancy system to perfect the land use system of countryside. Based on the analysis about the present situation and problems of the land use system of countryside, the article, to take the law as the point of departure, attempts to probe into the countryside land tenancy system, and puts forward that the leasehold of countryside land should be introduced into the Law of Rights over Things.
