论“后湄公河惨案时期”区域执法安全合作机制的构建

Theoretical Analyses on Regional Legal Security Cooperation Mechanism after “10.5 Mekong River Basin Case”

"湄公河惨案"发生后,中老缅泰执法安全合作引人注目。从实践层面的创新做法以中方为主导被不断提出,而理论上的提升与创新则较为薄弱。基于此,首先将研究范畴框定在国际关系学与国际法学的界限之内;并借鉴具备相关性和可比性的合作先例,如欧洲警察署、上合组织、东盟打击跨国犯罪合作机制等;提出在法律框架前提下,聚焦打击严重跨国犯罪,并通过提升安全公共产品的供给能力来实现合作的建议,以期对区域执法安全合作机制的后续发展提供理论支持。

After“10.5 Mekong river basin case”, the government and law enforcement agencies of China utilize the weapon of legal security cooperative mechanism, go abroad to curb the transnational crime and secure the regional security. All the practice urges scholars to make researches on initiatives and verifications and find a new cooperative mechanism. Our research and this paper are discussing on this type of asymmetric balance cooperation, learning from foreign and domestic precedent cases. It is hoped to set up strategic objectives,enhance the awareness on the regional security issue, and realize the regional security at last.
