论隐私权的法律保护

On Legal Protection of the Right to Privacy

隐私权作为一种典型的私权 ,是公民基本人权的重要组成部分之一 ,是一种独立的人格权。随着社会的进步与发展 ,隐私权的保护越来越受到人们的关注。然而 ,遗憾的是 ,时至今日 ,立法仍未明确将隐私权作为一种法律权利予以确认 ,有关隐私权的保护散见于若干法律之中。由于立法的缺陷 ,隐私权的保护往往于法无据 ,致使公民隐私权的司法救济显得相当尴尬和被动。因此 ,建立健全我国的隐私权保护制度势在必行。

As a typical private right, the right to privacy is an important integrant of basic human rights. It is an independent legal entity. With social progress and development, protection of the right to privacy is being paid more and more attention to. But it's a pity that the right to privacy is still not confirmed definitely as a legal right in legislation even to this day, only protection of the right of privacy being seen in certain laws. Because of legislation defect, protection of the right to privacy is utterly baseless from the angle of law and it makes the judicial relief awkward and passive. Therefore, it is imperative to establish and perfect legal system of the protection of the right to privacy.
