摘要
法律价值的冲突是指不同法律价值间存在的一种相互矛盾或相互排斥的状态。它主要体现在法律工具价值与法律目的价值的冲突,自由价值与秩序价值的冲突,效益价值与公平价值的冲突等方面。造成上述冲突的原因是多元的,当今时代要求在对法律价值冲突予以调整时必须遵循特定原则,运用多种方式对冲突中的法律价值进行倾向性选择。
The conflict of law values means that different law values are in a contradictory or rejecting state,which mainly refers to the following aspects:means and aim,freedom and order,benefit and justice,etc.The situation is due to many reasons,and this article will make a multi-angles analysis from value subject,human society,human nature and human reason.Adjusting it requires us to obey certain principles,adopt many methods and make a tendentious selection.
