论清末的商事立法

清末的商事立法是中国近代民族资本主义发展的必然结果 ,其内容非常丰富。清代的商事立法具有照搬西方立法成果、脱离国情、应急和承前启后等特点 ,清末的商事立法还未来得及实施 ,清王朝便灭亡了 ,因此 ,它并未发挥实际效应 ,但这些立法成果是此后中国商事立法的基础 ,在中国法制近代化的历程中具有重要的意义。

The Commercial legislation at the end of Qing Dynasty is the outcoming of China′s modern capitalistic development,whose content is very rich.And it also has the character of copying western legislation,separating itself from china′s reality,meeting an contingency of the time and serving as a link between past and future.As resticted by the historical conditions,it has little influence in the reality.Howerver,it furnished a solid basis for the coming commercial legislation.In this respect,it set a land mark on the chinas legal history.
