行政自由裁量权是行政权的重要组成部分 ,它的存在和正确行使是农业行政执法中不可或缺的。行政自由裁量权非正确行使会对农业行政执法造成严重的危害。正确行使自由裁量权要在遵循行政合理性原则的基础上 ,对其进行全面有效的监控 ,以有助于加强农业依法行政 ,最终实现依法治农的战略目标。

Administrative discretion is the integral part of administrative power, which existing and correctly exercising are necessary in administrative law enforcement of agriculture. The paper also points out the harm that non correctly exercised discretion. And last raises the suggestion of correctly exercising administrative discretionary power. That is, we should make an effective administer and all round control following the principle of administrative reasonableness in order to strengthening agricultural law enforcement and realizing the strategic objective which manage agriculture according to law.
