关于追究日本生化战战争责任的思考

Reflections on Ascertaining Japan's Responsibility of the Biochemical War during World War Ⅱ

由于政治的原因,美国在东京审判中免除了日本生化战罪责,但从法律形式上看,日本的生化战战争责任无法免除。90年代以来,人们从捍卫人权的角度对日本生化战争犯罪的追究和诉讼,从法理上其实是基于东京审判和纽伦堡审判中“对人道的犯罪”的原理。生化战伤害不是一般的战争伤害:一是它的极端反人道性,二是它的严重违背国际公约性,三是它的战后长期遗害性。战后赔偿诉讼的意义,并不完全表现在诉讼的结果上,而重要的是表现在其过程中,它的确切中了日本战争责任的要害。

Japan's responsibility for the biochemical war in World War II was relieved by the United States due to some political reason,but legally it couldn't be. Since 1990 it has been ascertained and accused of, the kgal base for which is the principle of ' the crime against humanity' established in Tokyo and Nuremberg Trials. The biochemical war goes a-gainst humanity and international conventions, and its harm is for long. The significance of claiming compensation lies not in the result but in the process of the lawsuit which hits the nail on the head of Japan's responsibility.
