试论我国夫妻财产制的修改完善

2001年4月28日通过的婚姻法修正案改进了我国的夫妻财产制。但这次修补式的修改没有从根本上建立和完善我国的夫妻财产制,不能完全满足调整现实婚姻家庭方面财产关系的需要。完善我国的夫妻财产制应增设通则性夫妻财产关系的一般规定;合理增加夫妻一方特有财产的种类,适当缩小夫妻共同财产的范围;进一步完善夫妻约定财产制,构筑我国夫妻约定财产制的完整体系。

The marriage law as amended has not put an end once and for all to the system of men and wives property. It can not meet the needs of property of the family connections. It is necessary to supply the additional regulations. Gradually reduce the scope of the common property, thus making perfect the structural system of the marriage law.
