论代际公平理论对环境法发展的影响

代际公平理论自20世纪80年代末提出以来,在国际社会引起了广泛的关注,并已成为可持续发展观的有力支持,同时,代际公平理论的提出使环境权主体和内容都有了具体的充实,并进一步对环境法的目的和价值取向产生影响。环境法中关于代际公平的研究还十分抽象和笼统,我们应当使代际公平理论在实际生活中得到具体化,推动环境法中代际公平理论在实践中取得新的发展。

The Intergeneration Fair theory was advanced in late eighti es of last centur y. Now, it has become the backing to the sustainable development idea. The publi cation of environmental law, such as teaching material and monograph, is always discourse on it. Foreseeingly, the discussion of Intergeneration Fair theory wil l make great impact on basic theories of environment law. The theory will produc e effect on objective and value-orientation of environmental law and it will inf luence on oblige and content of the rights of human and nature, too.
