宪政不仅仅是一种约束公共权力、建立有限政府的制度安排 ,更为重要的是 ,它还应表达观念性的宪政精神 ,体现民众的主体意识、宪政态度和宪政情感 ,蕴含一种正义性的现实关怀和世俗性的终极关怀。近代中国宪政努力的失败 。

After a simple track and inspect of the content of constitutionalism in western countries, this thesis argues that constitutionalism is not only an institutional agreement on limiting of public power and constructing limited government, more important, it should express subjectivity sense, attitudes and spirits toward constitutionalism of the people, with a just realistic concerning and a worldly ultimate concerning. The failure of constitutionalism in recent China is due to the absence of the constitutionalism spirit.
