我国当前群体劳动争议的概念辨析和应对思路

Analysis on the Concepts of Current Group Labor Disputes and the Reply Thinkings in China

我国当前的群体劳动争议是一种不同于集体劳动争议和多人劳动争议的新型劳动争议现象。引发群体劳动争议的原因是多方面的,其中值得特别重视的是:农民工劳动关系不稳定且处于"双重体制外"状态,而劳动关系协调机制存在不足而失灵。基于此,应对群体劳动争议的思路,应当从预防和处理这两个层面展开。预防的要点有:逐步提高劳动关系的稳定度;消除农民工"双重体制外"状态;畅通劳动者单个维权渠道;完善集体劳动关系协调机制。处理的要点有:选择以劳动争议仲裁机构为中心、相关机构或组织协同参与的群体劳动争议处理体制;处理程序设计应当注重查明争议内容和原因、平息群体对抗行动、协商调解和强制仲裁等环节。

At present, Group labor disputes is a new type of labor disputes in China which is different from collective labor disputes and collection of individual labor disputes. The cause of group labor disputes lies in many aspects, the most noteworthy of which is that rural migrant workers labor relations is unstable and is in the 'out-ofdual-system' status, and the coordination mechanism for labor relations problems is lack and failure. In this case, the ideas to deal with group labor disputes should be carried out from the two aspects of precaution and treatment. Some key points of precaution should be taken: gradually increasing the stability of labor relations; eliminating the 'out-of-dual-system' status of rural migrant workers; smoothing the channel of safeguarding individual legal rights; perfecting the coordination mechanism of collective labor relations. Some key treatment measures should be taken: selecting the treatment system of group labor disputes with labor dispute arbitration institution as the core and together with other relevant institutions or organizations participating; some treatment procedures should be designed such as finding out the controversial content and reason, quelling public backlash, consultation mediation and mandatory arbitration.
