摘要
我国《劳动合同法》第39、40、41条对于用人单位的单方解雇制度作出了比较详尽的规定,以解雇事由为主,同时涉及解雇程序、解雇救济等诸多方面的内容,通过深入分析和比较研究可以发现,法律的规定存在不少粗糙与缺漏的地方,可能为用人单位滥用解雇权埋下隐患。而在这个问题上,发达工业化国家与地区相关立法经验颇值得我们学习,惟有在借鉴优秀立法经验的基础上,重新对解雇制度进行精当的构思与设计,才能真正实现解雇制度中对于劳动者的倾斜性保护。
The 39 th, 40 th and 41 st items in Labor Contract Law in China have made a comparatively clear elaboration on the unilateral dismissal system, which mainly involves dismissal causes and some other contents like dismissal procedure and dismissal relief. Based on deep analysis and comparative study, a conclusion is achieved that there still exist some defects and missing points in the law, which may lay hidden troubles for the dismissal right abuse of employing units. Only by learning the excellent legislative experience as well as precisely conceiving and designing the dismissal system again can the inclining protection for the laborers be truly implemented in the dismissal system.
